AI ANALYSIS · U.S. COPYRIGHT OCT 13, 2026

You prompted an AI image. What part is your copyright?

A U.S. Copyright Office report separates prompting from human creative expression. Keep a record of what you actually created.

A detailed prompt alone does not establish copyright in the generated picture under the U.S. Copyright Office’s January 2025 report. That does not mean every work involving AI loses protection. The question is which expressive elements a human authored.

What the report says

The report was released on January 29, 2025. It says protection can cover perceptible human-authored expression, creative arrangements or creative modifications; merely providing prompts is insufficient. Using AI as an aid does not by itself bar copyrightability. The assessment is case specific.

Our view: keep the creative trail

For a practical record, save your original sketches, selected components and edited versions. Note which parts you drew, wrote or rearranged. This is our editorial recommendation for explaining a workflow, not a guarantee that a particular change qualifies for protection.

Permission to use is a different question

Before using a picture commercially, check the service terms and the rights in any material you supplied. A contractual permission and a claim that you authored the output answer different questions. Do not treat a “commercial use” label as a decision about your copyright.

Apply the right country’s rules

This article explains a U.S. report rather than a new ruling announced today. It does not settle another country’s law or a particular dispute. For a client deliverable, identify the relevant jurisdiction and the specific human contribution before making a rights promise.
